No subscription required.Carl Mayer and Adam Furgatch have a clever legal strategy could could unravel the toxic Citizens United decision. As early as June 14, the Court may decide to accept or decline an appeal of Montana’s 1913 law that bans corporate funding of political campaigns. They contend, under the 11th Amendment, that the Supreme Court does not have jurisdiction. If the Court accepts the case, it will violate the Constitution. If it declines the case, the decision of the Montana high court will stand, allowing states to ignore the Citizens United ruling in favor of state bans on corporate contributions.
Until the Court decides, we will present a series of podcasts with Mayer and his allies to provide updates and explore the details of the legal effort.
